Effective Date: October 1, 2026
BY OPTING IN TO RECEIVE TEXT MESSAGES FROM TSUNAMI EXPRESS, YOU AGREE TO THESE SMS TERMS AND CONDITIONS.
MARKETING TEXT-MESSAGE CONSENT IS NOT REQUIRED AS A CONDITION OF PURCHASING ANY MEMBERSHIP, PRODUCT, OR SERVICE.
MESSAGE FREQUENCY VARIES. MESSAGE AND DATA RATES MAY APPLY. REPLY STOP TO OPT OUT OR HELP FOR HELP.
These SMS Terms and Conditions (“SMS Terms”) govern text-message programs offered by Tsunami Express Intermediate Holdco and its affiliates operating under the Tsunami Express brand (“Tsunami,” “Tsunami Express,” “Company,” “we,” “us,” or “our”).
These SMS Terms apply to any text-message program through which Tsunami provides marketing, promotional, membership, billing, customer-service, operational, security, or other text communications.
These SMS Terms supplement Tsunami’s Terms and Conditions and Privacy Policy. If these SMS Terms expressly conflict with the Terms and Conditions regarding a text-message program, these SMS Terms control solely with respect to that text-message program.
Marketing messages may include promotions; discounts; coupons; free-wash offers; Founders Club offers; membership offers; grand-opening announcements; surveys; and other promotional content.
Tsunami will send automated marketing text messages only when it has obtained the consent required by applicable law.
Nonmarketing messages may include messages concerning an Account or Membership; payment or billing; membership renewal, pricing, or plan changes; cancellation or suspension; fraud, security, or authentication; customer-service interactions; customer-requested information; transactional confirmations; location or service operations; and legally required or contract-related notices.
The legal basis and consent requirements for nonmarketing messages may differ from those applicable to marketing messages. Providing a telephone number for an Account, Membership, transaction, or customer-service request does not by itself constitute consent to receive unrelated marketing messages.
Even if you opt out of marketing text messages, Tsunami may continue to send transactional, operational, Membership-related, billing-related, security-related, fraud-prevention, customer-service, and other nonmarketing messages to the extent permitted by applicable law.
When you affirmatively opt in to a Tsunami marketing text-message program, you authorize Tsunami and its service providers to send recurring marketing text messages to the mobile number you provided.
Messages may be sent using automated messaging technology or other messaging systems permitted by applicable law.
Your consent applies only to the program, sender, subject matter, and purposes disclosed when you opt in, unless you separately consent to another program or scope of messages.
Your marketing consent is voluntary and is not a condition of purchasing a Membership; receiving paid car wash services; purchasing another product or service; or maintaining an existing Account or Membership.
You represent that you are authorized to provide consent for the mobile number submitted.
Consent to receive marketing text messages is not a condition of purchasing a Membership, maintaining a Membership, receiving paid car wash services, or otherwise conducting ordinary business with Tsunami.
Certain promotional offers, sweepstakes, contests, discounts, coupons, Founders Club offers, or free-wash programs may require enrollment in a specific marketing program where permitted by applicable law and as disclosed in the applicable promotion.
Depending on the program, you may enroll by entering a mobile number on a website or mobile application; selecting an unchecked consent box; submitting an online form; texting a disclosed keyword to a designated number; enrolling at a kiosk or location; scanning a QR code and completing the displayed enrollment process; providing an electronic or written signature; or using another affirmative enrollment method described in the applicable call to action.
Tsunami may send an initial message confirming enrollment and providing required program disclosures.
Tsunami will not treat silence, inactivity, a preselected checkbox, or failure to opt out as affirmative consent to receive marketing text messages.
Tsunami may maintain records relating to enrollment, consent, confirmation messages, messaging preferences, and opt-out requests for compliance, operational, customer-service, and dispute-resolution purposes.
Message frequency varies. Tsunami does not guarantee a minimum or maximum number of messages. Message and data rates may apply. Your wireless carrier determines the charges associated with your mobile-service plan. Contact your wireless provider for information regarding your plan and billing.
You may revoke consent to receive messages from a Tsunami text-message program at any time by replying STOP to a message received from that program.
Tsunami may also recognize certain alternative opt-out requests supported by the applicable messaging platform, which may include CANCEL, END, QUIT, UNSUBSCRIBE, or similar commands.
You may also revoke consent through any other reasonable method permitted by applicable law.
Tsunami may send a final confirmation message confirming that your opt-out request has been processed. Opt-out requests will be processed in accordance with applicable law and the scope of the applicable messaging program.
Opting out of a marketing text-message program does not cancel a Membership; terminate recurring billing; close an Account; or revoke consent for communications through other independently authorized communication channels.
Tsunami may continue to communicate with you through methods authorized under the Terms and Conditions. Membership cancellations must be completed through the methods described in the Terms and Conditions.
For assistance, reply HELP to any Tsunami message. Message and data rates may apply.
Tsunami may respond with information identifying the program and providing customer-support contact information.
You may also contact Tsunami by email at [email protected] or by mail at Tsunami Express Intermediate Holdco, 4800 Meadows Road, Suite 200, Lake Oswego, Oregon 97035.
You represent that the mobile number you provide is accurate; you are authorized to receive messages at that number; and you will promptly notify Tsunami if the number changes, is disconnected, reassigned, or is no longer under your control.
If you relinquish or discontinue use of a mobile number, you should opt out before relinquishing the number and update your Account information.
Tsunami may suspend messages, require verification, or remove a number from a messaging program when it reasonably believes the number has been reassigned or is no longer controlled by the customer who enrolled.
Tsunami has no obligation to periodically verify ownership of a mobile number provided by a customer. Nothing in this section limits Tsunami’s obligations under applicable law.
Text-message delivery depends upon wireless carriers, telecommunications providers, messaging platforms, aggregators, networks, devices, and other third parties.
Tsunami does not guarantee delivery; delivery timing; delivery sequence; carrier compatibility; or uninterrupted availability.
Wireless carriers are not liable for delayed or undelivered messages.
Any text-message program may be delayed, modified, suspended, or discontinued because of carrier requirements, platform limitations, network conditions, legal requirements, security risks, technical issues, or other circumstances.
Tsunami’s Privacy Policy governs the collection, use, storage, disclosure, and protection of personal information associated with SMS programs.
The Privacy Policy is incorporated into these SMS Terms by reference. If a conflict concerning personal information practices exists, the Privacy Policy controls on that subject.
Tsunami may modify, suspend, replace, discontinue, or terminate a text-message program, sender number, keyword, message category, feature, or related functionality.
Tsunami may also revise these SMS Terms from time to time.
Material changes to these SMS Terms may be provided through any notice method permitted under the Terms and Conditions. Where applicable law requires advance notice, Tsunami will provide such notice before the change becomes effective.
A single notice covering updates to the Terms and Conditions, these SMS Terms and Conditions, the Privacy Policy, or any combination of those documents will satisfy any applicable notice obligation unless applicable law expressly requires otherwise.
Continued participation after the effective date of updated SMS Terms constitutes acceptance to the extent permitted by applicable law. Nothing in this section creates marketing consent where Tsunami has not otherwise obtained the consent required by applicable law.
Tsunami may change the telephone number, short code, toll-free number, 10-digit long code, keyword, platform provider, or technical delivery method associated with a messaging program at any time.
Tsunami’s Terms and Conditions are incorporated into these SMS Terms by reference, including provisions addressing electronic communications; Account responsibilities; limitation of liability; warranty disclaimers; informal dispute resolution; arbitration; class-action waiver; jury-trial waiver; arbitration opt-out rights; governing law; and limitation periods.
The arbitration provisions and 30-day arbitration opt-out procedure described in the Terms and Conditions apply to disputes arising from Tsunami text-message programs.
To the extent any dispute arises from participation in a Tsunami text-message program, the dispute-resolution procedures contained in the Terms and Conditions govern unless applicable law requires otherwise.
These SMS Terms, together with applicable enrollment disclosures; program-specific disclosures; Tsunami’s Terms and Conditions; and Tsunami’s Privacy Policy, constitute the agreement governing participation in the applicable Tsunami SMS program.
A program-specific disclosure controls only to the extent it expressly applies to a specific program and conflicts with these SMS Terms.
Your affirmative enrollment, electronic signature, submission of an opt-in form, transmission of an enrollment keyword, or other affirmative consent method may constitute your electronic acceptance of these SMS Terms.
You may retain a copy of these SMS Terms by printing or saving them from Tsunami’s website.
